DTH News : NewsX brings new development in the case of appointment of Chief Vigilance Commission

New Delhi, 8th February, 2011: Opening yet another fold in the recent case of appointment of the Chief Vigilance Commissioner, NewsX brings to limelight another development in the case that has sent shock waves throughout the nation. The channel is in exclusive possession of a secret office memorandum of Ministry of Home that shows how country's top corruption custodian, the Central Vigilance Commission casually clears tainted bureaucrats and makes them eligible for their appointment as Chief Vigilance Commissioner. The list shows that CVC, P.J.Thomas was not the only tainted bureaucrat who got a vigilance clearance despite a charge sheet pending against him. The Central Vigilance Commission had cleared seven more tainted officers with him and had made them eligible for CVC's post. In doing so the then CVC Pratyush Sinha had conveniently overlooked an office memorandum of the Ministry of Home Affairs making it mandatory to prepare a list of tainted officers and not consider them for sensitive postings. Names of most of these officers including Thomas should have figured in this list and they should not have been given vigilance clearance.

Documents available with the NewsX show that the Department of Personnel and Training had sent a list of nine Senior IAS officers to the CVC for clearance and almost all of them had serious charges against them ranging from misappropriation of funds, embezzlement, corruption, disproportionate assets to land scams.

B R Kundal's name topped the list. This 1972 batch IAS officer was charge sheeted for misappropriation of sale proceeds of essential commodities. He was cleared by the CVC along with P.J.Thomas. V Jayashankar, a 1973 batch IAS was also cleared by the CVC despite serious allegations, complaints against him like embezzlement, corruption and misuse of Govt. funds

P J Thomas was charge sheeted in Palmolein case. Kerala Govt had given prosecution sanction against him.

V S Dhumal, Tejinder Kaur, Ashok Kumar, Brajbehari Mahapatra were also accused of misusing their office and corrupt practices .But the top corruption watchdog gave vigilance clearance to all these IAS officers, flouting guidelines. This clearance made them eligible for the post of CVC.

Vigilance clearance to these tainted bureaucrats was given by the CVC, under former Chief Vigilance Commissioner Pratyush Sinha...A '69 batch IAS officer of Bihar Cadre; Sinha took over as the CVC in September 2006. He was appointed by the selection committee comprised of the then Prime Minister Manmohan Singh, the then Home Minister Shivaraj Patil and the then Leader of the Opposition L. K. Advani. Sinha completed his tenure in September 2010 and handed over his charge to P J Thomas.

The Supreme Court is upset with the way government vitiated the process of appointment of the CVC and also questioned PJ Thomas’s suitability for a post like Central Vigilance Commissioner.
