The cap of 200 SMSes per day per person has been restored with the Supreme Court on Monday staying the telecom appellate tribunal's order quashing the limit imposed by TRAI.
TDSAT had quashed the limit on the petition of Aditya Thackeray, son of Shiv Sena leader Uddhav Thackeray, on the ground that TRAI’s decision was violative of right to freedom of speech and expression.
TRAI moved the apex court arguing that the limit was enforced to strike a balance between the sender's right to freedom of speech and expression and the receiver's right to privacy.
While staying TDSAT’s order a bench of Justices G S Singhvi and Gyan Sudha Misra gave six weeks time to Aditya to respond.

Trai had imposed a limit of SMSs to 100 per day which was later raised to 200.
