General News Kashish Developers moves TDSAT against Tata Sky for disconnection of its news channel

MUMBAI: Kashish Developers, the owner of Hindi news channel Kashish News, has moved TDSAT against direct to home (DTH) operator Tata Sky due to disconnection of its channel from the latter’s platform.

The broadcaster was earlier having an agreement with Tata Sky under which its news channel was being distributed on the DTH platform.

According to learned counsel for Kashish Developers, the petitioner’s news channel is meant for Bihar and Jharkhand state only and it was being distributed as a regional news channel. However, this position is controverted by learned counsel for Tata Sky.

The broadcaster has yet not accepted to sign the RIO agreement with the DTH operator as required under the new Regulations, 2017. As a result, the distribution of its news channel has been disconnected since 29th June.

Kashish’s counsel contended that the target area for the petitioner’s news channels should confine to Bihar and Jharkhand then only it can survive otherwise it may lose on account of lack of Pan India penetration.

Learned counsel for Tata Sky submitted that on a DTH platform the respondent has no option but to treat the target area even in respect of petitioner’s channels as a Pan India channel.

The tribunal noted that legal issues are involved which have to be resolved. As prayed on behalf of Tata Sky, three weeks’ time is granted for filing reply. If required, time for filing rejoinder may be granted on the next date.

The matter has been posted under the same head on 25.07.2019.

The tribunal stated that the prayer for interim relief shall be considered on the next date. In the meantime, it will be open for the broadcaster to approach the DTH operator with the appropriate application and necessary details and the same shall be considered by the latter in accordance with the law.
