Help  HC Asks TV Channel to Pay 20 Cr in Defamation Case

The Bombay High Court has asked the company which runs a prominent English TV news channel to deposit Rs 20 crore with the court registry in a defamation suit filed by former Supreme Court judge P B Sawant.

The direction was given by Justice B H Marlapalle and Justice Nishita Mhatre yesterday while hearing an appeal filed by the broadcasting company against an order of a Pune Court, which had ordered payment of Rs 100 crore as damages to Justice Sawant for "defaming" him in a news bulletin.

The bench also asked the company to give bank guarantees for the balance amount of Rs 80 crore.

Justice Sawant had filed a defamation suit in Pune Court against the company for wrongly exhibiting his photograph for 15 seconds in a news bulletin on September 10, 2008, on a provident fund scam involving retired Calcutta High Court judge P K Samanta.

The report had alleged that several judges of the higher judiciary were involved in the scam and wrongly displayed the photograph of Sawant instead of Samanta.

This had angered Justice Sawant, who in his defamation suit, said it would imply that even he was involved in the scam.

Being aggrieved, Justice Sawant had issued a legal notice to the channel which carried a regret on its scroll some days after the news bulletin was telecast.

However, the former Supreme Court judge was not satisfied and moved a Pune court to claim Rs 100 crore in damages.

Pune Civil Judge (senior division) V K Deshmukh issued a decree asking the company to pay Rs 100 crore as damages to the aggrieved former Judge.

The TV company then challenged the order in the High Court which admitted its appeal and stayed the implementation of the decree after directing it to deposit Rs 20 crore with the registry.
