Tata Sky+ 30 day Challenge.

Tata Sky+ 30 day Challenge (“Offer”) can be availed of only by New Tata Sky subscribers (hereinafter referred to as “You”). The Offer entitles You to return your Tata Sky+ connection at any time before expiry of period of 30 days from the date of activation of Your
Tata Sky+ service and obtain a refund subject to the below stated terms.

New Tata Sky subscriber(s): Individuals who activate their Tata Sky+ connection between 15 May 2009 & 15 June 2009 (both days inclusive).
Tata Sky+ connection: The Tata sky+ digicomp, remote, Tata Sky hardware, & material
Material: Includes without limitation the following- Inbuilt power cord, and cables [6 types of cables in the box (s-video-1 no. , RF Cable – 01 no., Data Cable – 01 no., RCA Cable – 03 no’s]
Offer Period: 15 May 2009 – 15 June 2009

New Tata Sky subscribers availing of the Offer shall be bound by the following terms and conditions:
Offer valid for New Tata Sky subscriber(s) residing in Mumbai, Navi Mumbai, Thane Delhi (NCR).
The Offer is only applicable on purchase of a Tata Sky+ digicomp (including remote) worth Rs 8,999 during the Offer Period. You will need to recharge your Subscriber Account for monthly subscription of any Tata Sky Base Package separately.
You can avail of this Offer from any of the select Tata Sky retail outlets or via the cash on delivery option from the Tata Sky helpline.
The Offer is not applicable on credit card purchases made over the helpline.
The original carton and invoice copy must be returned along with the Tata Sky+ connection also.
At the time of de-installation of Your Tata Sky+ connection, You shall also receive a copy of the de-installation work order which must also be signed and returned to the Tata Sky retail outlet/Tata Sky Installation Service Provider (ISP) from whom You have purchased the Tata Sky+ connection.
Refund request must be placed on the Tata Sky helpline and request number be obtained. Direct requests made by You to the Tata Sky retail outlet will not be entertained.
The Tata Sky authorized representative shall visit You at the Address in the Tata Sky records and after ensuring that the Tata Sky+ connection is in proper working condition, the Tata Sky authorized representative shall repack the Tata Sky+ connection in the original carton and affix a 30 day challenge sticker on it.
No refund will be given to You in the following circumstances:
If You make the refund request call after 30 days from activation of Your Tata Sky+ service
If the Tata Sky+ connection or original carton or invoice or de-installation work order copy are missing or not provided by You at the time of return.
If there is any damage, physical or otherwise to the Tata Sky+ connection.
If the Tata Sky+ connection is not in working condition
The decision of Tata Sky in all matters of refund as listed above shall be final and binding and You agree not to dispute any such decision.
You acknowledge that the Tata Sky hardware has been provided to You on an entrustment basis only to avail of the Tata Sky+ service and Tata Sky shall repossess the same if you decide not to avail of the Tata Sky service. In the event a refund is requested for within 30 days of activation of your Tata Sky+ service, but you fail to return the Tata Sky hardware, this shall also disentitle You from returning the Tata Sky+ connection and obtaining a refund.
Subscription to one of the monthly Base Packages is mandatory at the time of activation of your Tata Sky+ service. You can also opt in to avail of any of the monthly Add on packages. The Account Balance in Your Subscriber Account shall be forfeited in case you return the Tata Sky+ connection.
If the return request is not received from You within 30 days from the date of activation of your Tata Sky+ service, then it shall be deemed that You have agreed to continue with the Tata Sky+ service and You will be charged Rs 1,000 towards the installation charges for the Tata Sky+ service. This amount shall be debited from your Subscriber Account. You will have 3 days from the expiry of the 30th day to recharge your Subscriber Account towards installation charges else your Subscriber Account will get deactivated.
Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Offer or to withdraw it completely.
On activation of the Tata Sky+ service, standard terms of the Tata Sky subscription contract will apply.
By availing of the Tata Sky+ service under this Offer, You hereby agree to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions. You agree to indemnify Tata Sky and its respective affiliates, advertising and promotion agencies, and all of its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from your or any third party's use (or misuse) of the Offer or Tata Sky+ service.
You acknowledge and agree that all disputes in relation to this Offer shall be exclusively subject to Delhi jurisdiction.
These terms and conditions are in addition to the Terms & Conditions of the Subscription Contract and if there are any inconsistencies between the two, these terms and conditions shall govern for the limited purpose as specified herein.
These terms and conditions shall not constitute a modification or waiver of any other provision of the Subscription Contract.
Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract.
