Update: Aadhaar Linking Deadline Will Be Extended Till March 31, Centre Tells Supreme Court

New Delhi: The Centre on Thursday told the Supreme Court that it will extend the deadline for mandatory linking of Aadhaar to various government schemes till March 31, 2018.

A bench headed by Chief Justice Dipak Misra was informed by Attorney General K K Venugopal that the Centre was willing to extend the deadline of December 31 to March 31 next year for linking of Aadhaar with various services and schemes.

The Attorney General, however, made clear that February 6 next year would remain the deadline for linking Aadhaar for availing uninterrupted mobile services as it had been mandated by the apex court.

Senior advocate Shyam Divan, appearing for those who are opposed to Aadhaar scheme told the bench, also comprising Justices A M Khanwilkar and D Y Chandrachud, that the central government should give an undertaking that no coercive steps would be taken against those fail to link their Aadhaar with various services.

The apex court will set up Constitution Bench next week to hear interim pleas seeking stay on Centre's move to link Aadhaar with various schemes and services.

The SC on October 30 had said that a Constitution Bench would commence hearing on the clutch of petitions against Aadhaar scheme from the last week of November.

Recently, a nine-judge constitution bench of the apex court had held that Right to Privacy was a Fundamental Right under the Constitution. Several petitioners challenging the validity of Aadhaar had claimed it violated privacy rights.

The Centre had on October 25 told the top court that the deadline for mandatory linking of Aadhaar to receive benefits of government schemes has been extended till March 31, 2018 for those who do not have the 12-digit unique biometric identification number and were willing to enrol for it.

Centre Extends Aadhaar-PAN Linking Deadline to March 31

New Delhi: The government on Friday extended the deadline for mandatory linking of PAN with Aadhaar by three months to March 31, 2018.

This is the third extension given by the government to individuals to link the Permanent Account Number (PAN) with the biometric ID.

The Centre had already informed the Supreme Court that it is willing to extend till March 31 the deadline fixed for mandatory linking of Aadhaar to avail various services and welfare schemes.

"It has come to notice that some of the taxpayers have not yet completed the linking of PAN with Aadhaar.

"Therefore, to facilitate the process of linking, it has been decided to further extend the time for linking of Aadhaar with PAN till March 31, 2018," the finance ministry said.

As of November, 13.28 crore out of 33 crore PANs have been linked to the 12-digit biometric identifier Aadhaar.

This year, the government made quoting of Aadhaar mandatory for filing income tax returns (ITRs) as well as obtaining a new PAN.

Section 139 AA (2) of the Income Tax Act says that every person having PAN as on July 1, 2017, and eligible to obtain Aadhaar, must intimate his Aadhaar number to the tax authorities.

The government had in August extended by four months the deadline for linking PAN with Aadhaar till December 31, pending the Supreme Court verdict.

The Supreme Court is hearing petitions challenging the government's decision on Aadhaar.

The apex court has said it may consider setting up of a constitution bench to hear pleas challenging the Centre's move to make Aadhaar card mandatory for availing various services and benefits of welfare schemes.

The deadline for linking PAN with Aadhaar previously was July 31 but was extended to August 31 and later to December 31, 2017.

Deadline for Linking Aadhaar to Bank Account Extended

New Delhi: The government has extended till further notice the December 31 deadline for mandatory quoting of national biometric identifier Aadhaar and PAN for certain financial transactions like opening of a bank account.

While the deadline has been withdrawn through a Gazette notification issued on Tuesday, new timelines will be intimated later.

The new rule notified in the Gazette modifies the Prevention of Money Laundering Act of 2002 to replace the requirement of submitting "the Aadhaar number and Permanent Account Number by December 31, 2017" with a provision saying "submit the Aadhaar number, and Permanent Account Number or Form No. 60, by such date as may be notified by the Central Government".

While the 12-digit Aadhaar is issued by the Unique Identification Authority of India (UIDAI), PAN is allotted by the Income Tax Department. Form 60 is a declaration filed by an individual or a person (not being a company or firm) who does not have a PAN and who enters into any specified transaction.

Tuesday's notification by the Department of Revenue in the finance ministry effectively paves the way for extending the deadline for mandatory quoting of Aadhaar for activities like the opening of a bank account.

This is in line with the Centre last week informing the Supreme Court that it is willing to extend till March 31 the deadline fixed for mandatory linking of Aadhaar to avail various services and welfare schemes.

On December 7, the deadline for linking PAN with Aadhaar was extended by three months to March 31, 2018.
Under the PMLA, Aadhaar, PAN and other official documents are required to be obtained by banks and financial institutions from anyone opening a bank account as well as for any financial transaction of Rs 50,000 and above.

The notification issued yesterday stated that accounts where Aadhaar and PAN are not furnished by the date notified by the government will cease to be operational.

If the account holder "fails to submit the Aadhaar number and PAN by such date as may be notified by the central government, the said account shall cease to be operational till the time the Aadhaar number and Permanent Account Number are submitted by the client", it said.

The Prevention of Money Laundering Act (PMLA) forms the core of the legal framework put in place by India to combat money laundering and generation of black money.

The PMLA and its rules impose an obligation on reporting entities like banks, financial institutions and intermediaries to verify the identity of clients, maintain records and furnish information to the Financial Intelligence Unit of India (FIU-IND).

As per Rule 9, every reporting entity shall at the time of commencement of an account-based relationship identify its clients, verify their identity and obtain information on the purpose and intended nature of the business relationship.

Intermediaries like stockbroker, chit fund company, cooperative bank, housing finance institution and non-banking finance companies are also classified as reporting entities.

The broad rule also applies to all cash dealing of more than Rs 10 lakh or its equivalent in foreign currency, cash transactions where forged or counterfeit currency notes have been used and all suspicious dealings.

All cross-border wire transfers of more than Rs 5 lakh in foreign currency and purchase and sale of immovable property valued at Rs 50 lakh or more also fall under this category, according to the reporting rules.

The notification issued yesterday said amendments are being made in Rule 9 of the Prevention of Money-laundering (Maintenance of Records) Rules, 2005.

SC Extends Aadhaar-Linking Deadline for Mobile Phones, Bank Accounts To March 31

New Delhi: The Supreme Court on Friday extended the deadline for Aadhaar linking of all services and schemes, including mobile phones, provident fund and bank accounts. The new deadline is March 31.

The SC said the deadline has also been extended for schemes run by state governments. The court said new bank accounts can be opened without Aadhaar but applicant needs to submit proof that he has applied for the card.

A five-judge Supreme Court bench is hearing a clutch of pleas seeking a stay on government's decision of mandatory linking of Aadhaar with welfare schemes.

The Centre had told the apex court on Thursday that it would extend the deadline. However, the Centre vehemently pressed before the constitution bench headed by Chief Justice Dipak Misra for allowing the national biometric identifier to remain mandatory for opening new bank accounts.

The top court, which fixed the main petitions challenging the Aadhaar scheme itself for final hearing on January 17 next year, said it would consider the submission of Attorney General K K Venugopal that deadline of February 6, 2018 for mandatory linking of Aadhaar with mobile services can also be extended up to March 31 next year.

Venugopal had referred to an earlier apex court order asking the Centre to ensure verification of existing and new mobile users by February 6 and hence, the government, on its own, cannot extend the deadline.

"The deadline for almost everything has been extended," Venugopal said, adding that Aadhaar was mandatory for new bank accounts and several crores of existing bank accounts have already been linked.​
